Terms and conditions of the Plava Laguna Club loyalty programme

1. GENERAL INFORMATION ABOUT THE PROGRAMME

The purpose of the Plava Laguna Club loyalty programme is to enable clients of Plava Laguna d.d. who join the Programme to access the benefits described below.

2. DEFINITIONS

Plava Laguna Club: A brand (word and figurative trademark) owned by Plava Laguna d.d., which is the organiser of the loyalty programme and the owner of the properties participating in the programme. Plava Laguna d.d., as the main body responsible for the implementation of the Programme, guarantees the rights provided for under this Programme, requires compliance by members and/or provides other guarantees to members. Programme: The loyalty programme organised by Plava Laguna under the name Plava Laguna Club. All copyrights relating to the Programme belong exclusively to Plava Laguna d.d. Client: A client who has not yet joined the Programme and accepted the Programme Terms and Conditions. Member: A client who has joined the Programme and accepted the Programme Terms and Conditions. Point: A unit of value expressed in points. Points may be redeemed for discounts or other services within hotels, apartments and villas managed by Plava Laguna d.d., as well as with Programme Partners where applicable. Ten (10) points are equivalent to EUR 1.00. Card: The Plava Laguna Club card is issued in digital form and is provided to the Member upon online enrolment in the welcome email. The Plava Laguna Club card is non-transferable. Physical cards issued by 31 December 2022 remain valid. Programme Partner: A business entity outside Plava Laguna d.d. that provides benefits to Programme members.

3. MEMBERSHIP CONDITIONS

Any adult natural person may join the Programme by completing the required information via the online registration form. In order to become a Member, the Client must provide the required data and complete the form. The information entered upon enrolment must correspond to the data shown on the Client’s personal identification documents. Plava Laguna d.d. shall not be liable for any inability to use Programme benefits resulting from inaccurate or incomplete information provided by the Client or Member of the loyalty programme. Membership in the Programme is free of charge. A Member may terminate their membership at any time by giving written notice. Termination implies withdrawal from the Programme, whereby the existing relationship between the Member and the Plava Laguna Club Programme permanently ceases and all benefits associated with Programme membership lapse.

4. PLAVA LAGUNA CLUB MEMBERSHIP NUMBER

Upon enrolment, the Client is assigned a membership number, which enables the collection of points and access to various benefits and discounts. In order to collect points, the Member must provide their membership number when making an accommodation reservation at hotels or apartment resorts managed by Plava Laguna d.d., upon check-in at such properties, and when settling bills at those properties. For the purpose of collecting points, the Member is also required to present their membership number at the reception desk or at food and beverage outlets managed by Plava Laguna d.d., as well as when using benefits offered by Programme Partners, where applicable. Use of the membership number is conditional upon the presence of the Member to whom it has been issued. The membership number may not be lent, transferred or sold to third parties; failure to comply will result in the loss of all rights under this Programme. The Member is responsible for all activities related to their Plava Laguna Club account. Each Member is required to notify Plava Laguna d.d. of any changes to their personal details (first name, last name, address, email address). Plava Laguna Club membership remains the property of Plava Laguna d.d., which reserves the right to withdraw or refuse acceptance of a membership number if it is used in a manner contrary to these Terms and Conditions.

Plava Laguna d.d. further reserves the right to withdraw or refuse membership and to cancel the use of previously collected points if, during any stay at Plava Laguna properties, the Member fails to settle the charges for accommodation services and any additional services no later than the day of departure. The same applies to persons accompanying the Member. In such cases, the Member and their accompanying persons may also be denied any future newly issued membership in the Plava Laguna loyalty programme.

5. PROGRAMME BENEFITS

By enrolling in the loyalty programme, Members are entitled to discounts and benefits. Members are eligible for discounts when making online bookings via plavalaguna.com. Members are also entitled to special offers that are periodically published in their online profile on plavalaguna.com. Where applicable, to redeem benefits offered by Programme Partners (such as discounts on excursions, restaurants, car rental services and other activities), the Member must present their membership number to the relevant Programme Partner. Plava Laguna d.d. is not the provider of the services offered by Programme Partners and does not guarantee the quality of such services. Programme Partners are solely responsible for the provision of their services and for any liability or compensation for damage arising from the provision of those services. Plava Laguna d.d. reserves the right to terminate cooperation with Programme Partners at any time, without stating reasons.

In general, Members earn points for each stay at hotels, apartments and villas managed by Plava Laguna d.d. (exclusively for the accommodation unit in which they are staying). Points may be redeemed during a subsequent stay at participating Plava Laguna hotels, apartments and villas, as well as with Programme Partners, where applicable. Club Members will receive information on current offers and promotions, appropriate promotional materials, satisfaction and quality surveys, and other customer-experience-related questionnaires via the email addresses and telephone numbers (by SMS) provided upon enrolment. Members may unsubscribe from receiving such communications at any time.

6. MEMBER DISCOUNTS AND OFFERS ON THE WEBSITE

By enrolling in the loyalty programme, Members are entitled to discounts and benefits. Members are eligible for discounts when making online bookings via plavalaguna.com. Members are also entitled to special offers that are periodically published in their online profile on plavalaguna.com. The above discounts and benefits apply only to Members who provide their membership number at the time of booking. Plava Laguna d.d. reserves the right to amend or withdraw discounts and preferential pricing at any time, without prior notice, subject to availability. One Member may receive discounts for a maximum of five accommodation units.

7. POINT ACCRUAL

Members earn points for each stay at hotels, apartments and villas managed by Plava Laguna d.d. (exclusively for the accommodation unit in which they are staying). Points may be redeemed during a subsequent stay at participating Plava Laguna hotels, apartments and villas, as well as with Programme Partners, where applicable. Points are awarded for the accommodation unit occupied by the Member and for the paid invoice relating to that unit. If a Member wishes to earn points for additional accommodation units, they must be both the payer and the named recipient of the invoice for those units. This is possible only for accommodation units located within the same hotel or apartment resort and must be requested at the property’s reception desk prior to settling the invoice. Invoices of up to EUR 10,000.00 may be paid in cash. For invoices exceeding this amount, payment must be made by card or via bank transfer. Point accrual applies to stays at hotels, apartments and villas managed by Plava Laguna d.d. that take place after the Client has joined the loyalty programme. When redeeming benefits, ten (10) points are equivalent to EUR 1.00 (e.g. a Member who has accrued 100 reward points is entitled to redeem EUR 10.00 during their next stay). In order to accrue points or redeem benefits or points, the Member must provide their membership number when booking accommodation at Plava Laguna hotels, apartments and villas, upon check-in at the hotel or apartment resort, and when settling the invoice at the property. Available points may not be used to reduce the accommodation price at the time of booking. Points may be redeemed exclusively for the payment of accommodation costs at Plava Laguna hotels, apartments and villas at the property’s reception desk. The maximum discount obtainable through the redemption of points may not exceed 90% of the total amount payable for the Member’s stay at a Plava Laguna property (hotels, apartments and villas managed by Plava Laguna d.d.). Each time points are redeemed for accommodation, they are deducted from the Member’s account. Points are not awarded for stays that took place prior to the launch of the Plava Laguna Club loyalty programme.

Points may be earned in the following ways:

a) Stay – For each euro spent on accommodation at Plava Laguna hotels, apartments and villas, the loyalty programme Member earns one (1) point credited to their Plava Laguna Club account. Eligible accommodation costs are defined in Section 7.1. When settling the invoice at the reception desk, the Member must present their membership number.

b) Food and beverage consumption – For each euro spent on food or beverages at food and beverage outlets operated by Plava Laguna d.d., the Member earns one (1) point credited to their Plava Laguna Club account. The membership number must be presented at the time of payment.

c) Promotional activities – Plava Laguna d.d. may award points for promotional purposes. In order to use Programme benefits, the Member must provide their membership number when booking accommodation at Plava Laguna hotels, apartments and villas, present it upon check-in at the property, and again when settling the invoice. These conditions must be complied with.

7.1. Eligible Stay Costs

Eligible stay costs include costs incurred during the stay of the Member and their accompanying persons at hotels, apartments and villas managed by Plava Laguna d.d. These include all accommodation-related costs (the accommodation unit rate, per-person charges, various supplements and applicable fees), services consumed on site at points of sale within hotels, apartments or villas managed by Plava Laguna d.d. (food and beverage consumption), as well as VAT. Points are calculated based on the total amount of eligible stay costs paid. The invoice must be issued in the name of the Programme Member. Points are credited to the Plava Laguna Club account one day after checkout from the accommodation unit. Point accrual may not be combined with other membership cards. Exceptions: Non-eligible costs include extra-board services such as room service, internet fees, cleaning services, telephone charges, parking fees, tourist tax, tips, service charges and other applicable fees, in-store purchases, hairdresser or barber services, sports activities, and golf green fees. Points are awarded only for eligible costs that have been effectively paid, after any points earned from previous stays have been redeemed. Points begin to accrue for stays taking place after the guest has joined the Programme.

7.2. Who May Earn Points and Use Discounts

Clients who use services provided by Plava Laguna d.d. through travel agencies or who book accommodation via online travel agency platforms are not entitled to discounts or to earn points for stays at hotels, apartments and villas managed by Plava Laguna d.d. Points referred to in the preceding sentence may likewise not be used to pay for stays at hotels, apartments and villas managed by Plava Laguna d.d. Only Members who arrive at Plava Laguna properties (hotels, apartments and villas managed by Plava Laguna d.d.) through Plava Laguna direct channels (plavalaguna.com, the Reservation Centre or the reception desk) are entitled to discounts and to earn points. The online Member discount applies exclusively to bookings made via plavalaguna.com. It does not apply to bookings made through the Reservation Centre or at the reception desk. Members may earn points for all on-site expenses incurred at points of sale within hotels or apartment resorts managed by Plava Laguna d.d. (such as food and beverage consumption). All points-eligible points of sale are clearly marked. The membership number may be used only by the Member to whom it has been issued. If a Member does not stay at a hotel, apartment or villa managed by Plava Laguna d.d., discounts and point accrual are not available. Points may be transferred to other Members. For this purpose, a point transfer request must be submitted (online via plavalaguna.com or through the Reservation Centre).

7.3. Validity of Reward Points

Points are valid for two (2) years (24 months) from the date on which they are accrued. The validity of points is not extended; all points remain valid for a period of two years from the date of accrual. Where only part of the available points is redeemed, points accrued earliest will be redeemed first. Points that are not redeemed by their expiry date will be removed from the Member’s account without notice and without any right to reinstatement, refund or exchange. Membership in the Programme remains valid. Points have no cash value. Points are awarded only for eligible costs that have been effectively paid, after the Member has redeemed any previously accrued points.

8. PROPERTIES PARTICIPATING IN THE PROGRAMME

The properties owned by Plava Laguna d.d. and participating in the Programme are as follows: Hotels: Hotel Albatros Plava Laguna, Hotel Molindrio Plava Laguna, Hotel Zorna Plava Laguna, Hotel Parentium Plava Laguna, Hotel Mediteran Plava Laguna, Hotel Plavi Plava Laguna, Hotel Istra Plava Laguna, Hotel Gran Vista Plava Laguna, Hotel Materada Plava Laguna, Hotel Delfin Plava Laguna, Villa and Village Galijot Plava Laguna, Hotel Park and Garden Suites Park Plava Laguna, Hotel Pelegrin Plava Laguna, Hotel Aurora Plava Laguna, Hotel and Residence Garden Istra Plava Laguna, Hotel Umag, Residence Umag and Garden Suites Umag Plava Laguna, Hotel Sipar Plava Laguna. Apartments and Villas: Apartments Galijot Plava Laguna, Apartments Bellevue Plava Laguna, Villas Bellevue Plava Laguna, Apartments Park Plava Laguna, Villas Park Plava Laguna, Apartments Astra, Istrian Villas Plava Laguna, Apartments Katoro Plava Laguna, Apartments Amfora Plava Laguna, Apartments Stella Plava Laguna, Apartments Polynesia Plava Laguna, Apartments Savudrija Plava Laguna, Rooms Savudrija Plava Laguna, Apartments Kanegra Plava Laguna. Plava Laguna d.d. may amend or expand this list from time to time.

9. DATA PRIVACY

The use and protection of personal data collected by Plava Laguna d.d. from the Member (as a data subject) are governed by the Privacy Policy published on plavalaguna.com. For any questions relating to personal data, the Member may contact the Data Protection Officer by email at dpo@plavalaguna.com.

10. AMENDMENTS TO THE PROGRAMME TERMS AND CONDITIONS

Plava Laguna d.d. reserves the right to suspend or amend the terms of the Plava Laguna Club loyalty programme, in whole or in part. Plava Laguna d.d. will take all reasonable steps to inform Members in a timely manner of any amendments to or suspension of the Programme and shall not be liable for any losses or damages incurred by Members upon the entry into force of such amendments. The current version of the Programme Terms and Conditions is available at plavalaguna.com.

11. PROGRAMME COMMUNICATIONS

Members may access all information relating to the Programme at plavalaguna.com. For any questions regarding membership, as well as notifications of changes to personal details or any other information relevant to membership, Members may contact Plava Laguna d.d. by email at loyalty@plavalaguna.com or via the online contact form. If a Member notices that points have not been correctly credited to their account, they may submit a request by email to loyalty@plavalaguna.com , together with a copy of the invoice for the property at which they stayed.
