Terms and conditions of the Plava Laguna Club loyalty programme

1. GENERAL INFORMATION

The goal of Plava Laguna Club Loyalty Program is to enable the clients of Plava Laguna d.d. who are participating in the program, using the benefits described below.

2. DEFINITIONS

Plava Laguna Club: brand (verbal and figurative trademark) owned by Plava Laguna d.d. as the organiser of the Loyalty Programme and the owner of the accommodation facilities participating in the Programme. Plava Laguna d.d. is the company that implements the Programme and acts as the main body guaranteeing the rights prescribed as part of this Programme, whereby it requires the accountability of the Members and/or provides Members with other guarantees. Programme: loyalty programme organised by Plava Laguna under the name Plava Laguna Club. Any copyright related to the Programme shall belong exclusively to Plava Laguna d.d. Client: client who has not yet joined the Programme or accepted the General Terms and Conditions of the Programme. Member: client who has joined the Programme and accepted the General Terms and Conditions of the Programme. Point: unit value expressed in Points. Points can be redeemed for discounts or other services within the hotels, apartments and villas managed by Plava Laguna d.d. Ten (10) Points are worth EUR 1.00. Card: the Plava Laguna Club Card comes in digital form, and Members receive the Card in their welcome e-mail upon joining the Programme online. The Plava Laguna Club Card is not transferable to other persons. Cards in physical form that were being issued up to 31 December 2022 are still valid. Programme Partner: business entity outside Plava Laguna d.d. that provides benefits to Members of the Programme.

3. MEMBERSHIP CONDITIONS

Any natural person over the age of 18 can join the Programme by filling in the required information in the online application form. In order to become a Member, the Client must provide the necessary information and fill in the application form. Membership in the Programme is free of charge. Any Member may at any time terminate their membership in the Programme with a written notice. Termination shall imply withdrawal from the Programme, which permanently ends the existing relationship between the Member and the Plava Laguna Club Programme, and all the benefits related to membership in the Programme shall cease.

4. PLAVA LAGUNA CLUB MEMBERSHIP NUMBER

Upon registration, the Client shall receive their membership number, which may be used to collect Points and gain access to various benefits and discounts. In order to collect Points, Members shall indicate their membership number when booking accommodation, checking in at accommodation facilities, and making payments. The membership number may only be used if the Member in whose name the membership number has been issued is present. The members shall not lend, transfer or sell the membership number; otherwise they lose all rights arising from the Programme. Each Member shall be responsible for all activities related to their Plava Laguna Club account. Members shall notify Plava Laguna d.d. in case of change of personal data (name, surname, address, e-mail address). Plava Laguna Club membership is owned by Plava Laguna d.d., and Plava Laguna d.d. shall reserve the right to withdraw or reject a membership number if the member fails to comply with the membership terms and conditions while using the membership number.

Furthermore, Plava Laguna d.d. reserves the right to cancel and not accept a membership and the use of the previously collected points if the member fails to settle the invoice for the provided accommodation services as well as other services during any of their stays at the accommodation units of Plava Laguna no later than on the day of their departure from the accommodation unit. The same applies to persons accompanying the member, and the member and the persons accompanying the member will be denied renewed membership in the Plava Laguna loyalty programme.

5. BENEFITS OFFERED BY THE PROGRAMME

Members of the Loyalty Programme shall be entitled to discounts and benefits. When booking online via the plavalaguna.com website, Members shall be entitled to discounts in the amount of up to 10% (depending on availability) on the lowest possible price of accommodation. Members shall also be entitled to special offers periodically published on their online profile at plavalaguna.com. In general, Members collect Points for each stay (only for the accommodation unit in which they are staying), which can be used the next time they stay in the accommodation facilities participating in the Programme. Club Members shall receive information about current offers and deals, suitable promotional materials, satisfaction/quality surveys and other surveys related to their user experience at the Plava laguna d.d. facilities at the e-mail addresses and telephone numbers (via SMS) indicated in their application form. Club Members shall have the right to unsubscribe from such notifications at any time.

6. DISCOUNTS AND OFFERS FOR MEMBERS ON INTERNET PAGES

Members of the Loyalty Programme shall be entitled to discounts and benefits. When booking online via the plavalaguna.com website, Members shall be entitled to discounts in the amount of up to 10% on the lowest possible price of accommodation. Members shall also be entitled to special offers periodically published on their online profile at plavalaguna.com. Such discounts and benefits shall apply only to Members who indicate their membership number at the time of booking. Plava Laguna d.d. reserves the right to modify or terminate discounts and price advantages related to its offers without prior notice, depending on availability. One Member can benefit from a discount for a maximum of five accommodation units.

7. COLLECTION OF POINTS

Members collect Points for each stay, which they can use during their next stay in any of the accommodation facilities participating in the Programme. Points can be collected for the accommodation unit in which the Member is staying, on the basis of the invoice pertaining to their stay in that accommodation unit. If a Member wants to collect Points for other accommodation units, then that Member must be indicated as both the payer and the holder of the invoice pertaining to those accommodation units. This is possible only when the accommodation units are located in the same hotel/apartment complex, and the Member shall communicate their intention to collect Points for other accommodation units to the personnel at the reception of the facility where they are staying prior to paying the invoice. Invoices up to EUR 10,000.00 can be paid in cash; however, invoices exceeding this amount shall be paid by card or bank transfer. Points can be collected only for stays that occur after the client has joined the Loyalty Programme. At least 7 days shall pass between the transaction in which the Member collected the Points and the transaction in which they intend to use the Points. When using the benefits, 10 Points are worth EUR 1.00 (which means, for example, that a Member who has collected 100 reward Points shall be entitled to a discount in the amount of EUR 10.00 during their next stay). Members shall present their membership number when booking accommodations, upon check-in, and when making payments in order to request points collection or use. Points can be used only to pay for the cost of accommodation at the reception desk of the accommodation facility in question. The maximum amount of the discount that a Member can get by using the Points shall not exceed 90% of the total invoiced amount that the Member is required to pay for their stay in the accommodation facility. Each time a Member redeems their Points in order to pay for accommodation, those Points shall be deleted from the Member’s account. Points shall not be awarded for stays that preceded the launch of the Plava Laguna Club Loyalty Programme. There are three ways of collecting points:

a) Stay – Loyalty Programme Members shall get 1 Point added to their Plava Laguna Club account for every euro spent to pay for accommodation. Applicable accommodation costs are defined in Article 7.1. Members shall present their membership number when making payments at the reception desk or points of sale.

b) Consumption at the catering facilities of Plava Laguna d.d. – Loyalty Programme Members shall get 1 Point added to their Plava Laguna Club account for every euro spent to pay for food or beverages at the catering facilities of Plava Laguna d.d. Members shall present their membership number when making payments. Points cannot be used to pay for food or beverages at the catering facilities of Plava Laguna d.d.;

c) Promotional activities – Plava Laguna d.d. may award Points for promotional purposes. In order to be able to access the benefits of the Programme, Members shall indicate their membership number when booking accommodation, as well as when checking in at the accommodation facility, and when making payments. These conditions must be complied with.

7.1. Eligible accommodation costs Eligible accommodation costs shall include the costs incurred during the stay of a Member, and the persons accompanying that Member, at the chosen accommodation facility. This shall include all costs pertaining to accommodation (price of the accommodation unit, price per person, various surcharges, various fees), and those pertaining to services provided on site at points of sale within hotels, apartments or villas which are managed by Plava Laguna d.d. (consumption of food and beverages), as well as VAT. Calculation of Points is based on the total amount of eligible accommodation costs paid. The invoice must be addressed to the Loyalty Programme Member. Points shall be added to your Plava Laguna Club account one day after check-out from the accommodation unit.

Collection of Points cannot be combined with other membership cards. Exceptions: Non-eligible costs shall include costs for services that are not related to boarding itself, such as: minibar, room service, internet fee, cleaning, telephone, parking fee, tourist tax, tips, service charges and other applicable charges, in-store purchases, hairdresser or barber services, sports services, and green fee for golfing. Points shall only be awarded for actually paid eligible costs after the Member redeems Points earned during previous stays. Points shall start to accumulate for stays only after the guest has become a Member of the Programme.

7.2. Who can collect points and use discounts Clients who use services of Plava Laguna d.d. through agencies or clients who book accommodation via portals of online travel agencies shall not be entitled to discounts or collection of Points by staying in the accommodation facilities of Plava Laguna d.d.; neither shall they be entitled to use Points to pay for their stay. Only the Members who have booked accommodation via Plava Laguna channels (plavalaguna.com, Reservations centre, reception desk) shall be eligible for discounts and collection of Points. Online discount for Members shall be valid only for bookings made via plavalaguna.com, and shall not apply for bookings made through the Reservation centre or reception desk. Points can be collected for all expenses that happen on the spot (food and beverage consumption and the like) at points of sale within an accommodation facility which are managed by Plava Laguna d.d. All points of sale where Points can be collected shall be marked as such. A membership number shall only be used by the member to whom it is addressed. If a Member does not book a stay at an accommodation facility of Plava Laguna d.d., use of discounts and collection of Points shall not be possible. Points can be transferred to other Members. For this purpose, it is necessary to fill in the request for the transfer of Points (online at plavalaguna.com or via the Reservations centre).

7.3. The validity of prize points Points shall be valid for three years (36 months) from the moment of their collection at the reception desk. The validity of the Points cannot be extended; all collected Points are valid for three years from the date of collection. When using not all but only part of collected Points, the earliest collected Points shall be used first. If points are not redeemed by the expiration date, these points shall be deleted from the member's account without notification and without the possibility of their return or exchange. Programme Membership shall remain valid. Points have no cash value. Points shall only be awarded for actually paid eligible costs after the Member redeems previously earned Points.

8. ACCOMMODATION FACILITIES PARTICIPATING IN THE PROGRAM

Accommodation facilities owned by Plava Laguna d.d. and participating in the Programme are as follows: Hotels: Hotel Albatros Plava Laguna, Hotel Molindrio Plava Laguna, Hotel Zorna Plava Laguna, Hotel Parentium Plava Laguna, Hotel Mediteran Plava Laguna, Hotel Plavi Plava Laguna, Hotel Istra Plava Laguna, Hotel Gran Vista Plava Laguna, Hotel Materada Plava Laguna, Hotel Delfin Plava Laguna, Villa and Village Galijot Plava Laguna, Hotel and Garden Suites Park Plava Laguna, Hotel Coral Plava Laguna, Hotel Aurora Plava Laguna, Hotel and Residence Garden Istra Plava Laguna, Hotel Umag Plava Laguna, Residence and Garden Suites Umag Plava Laguna, Hotel Sipar Plava Laguna. Apartments and villas: Apartments Galijot Plava Laguna, Apartments Bellevue Plava Laguna, Villas Bellevue Plava Laguna, Apartments Park Plava Laguna, Villas Park Plava Laguna, Apartments Astra Plava Laguna, Istrian Villas Plava Laguna, Apartments Katoro Plava Laguna, Apartments Amfora Plava Laguna, Apartments Stella Plava Laguna, Apartments Polynesia Plava Laguna, Apartments Savudrija Plava Laguna, Rooms Savudrija Plava Laguna, Apartments Kanegra Plava Laguna. Plava Laguna d.d. reserves the right to expand or modify the list from time to time.

9. DATA PRIVACY

The processing and protection of personal data Plava laguna d.d. collects from its members (as data subjects) is subject to the Privacy Policy published at plavalaguna.com. For any questions relating to personal data, members may contact us via e-mail at dpo@plavalaguna.com.

10. AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS OF THE PROGRAM

Plava Laguna d.d. reserves the right to suspend or modify, in whole or in part, the terms and conditions of the Plava Laguna Club Loyalty Programme. Plava Laguna d.d. shall take all necessary steps to notify Members in a timely manner of possible modifications or suspension of the Programme, and shall therefore not be liable for any loss or damage to Members upon entry into force of said modifications. The current general terms and conditions of the Programme are available at plavalaguna.com.

11. NOTES ABOUT THE PROGRAM

A member can view all the information related to the Programme on the plavalaguna.com website. For any questions regarding membership, as well as notifications about changes in personal data or any other important membership-related information, Members shall contact Plava Laguna d.d. at the e-mail address: loyalty@plavalaguna.com or via the online contact form. . If a Member notices that the Points have not been properly awarded to their account, they can contact Plava Laguna d.d. at the e-mail address loyalty@plavalaguna.com attaching a copy of the invoice of the accommodation facility in which they stayed.
